1. Accepting these terms

These Terms & Conditions (“Terms”) are a legally binding agreement between you and the operator of RiseJewels (“we”, “us”, “our”). They apply when you use our website, mobile experiences, and related services (together, the “Services”).

RiseJewels operates as an online marketplace: we provide the venue and tools; individual sellers are responsible for their listings, items, and fulfilment unless we say otherwise.

If you use the Services on behalf of a business, you represent that you have authority to bind that business to these Terms.

2. Other policies that apply

Our Services connect buyers and sellers in one place, so additional rules may apply depending on how you use RiseJewels:

• Everyone: these Terms and our Privacy Policy.
• Sellers: shop registration, listing fees, and seller tools described in your Shop Manager and at checkout.
• Buyers: order flow, messaging, and refunds or disputes as described in these Terms and in-order communications.

If any specialised policy conflicts with these Terms on a specific point, the more specific policy controls for that topic.

3. Your privacy

We explain how we collect and use personal information in our Privacy Policy. Sellers may also receive buyer data (for example shipping addresses) to complete orders—they must handle that data lawfully and only for the order.

4. Your account

Some features require an account. When you register, you agree that:

• A. Age & capacity. You are at least 18 years old, or you are using the Services under the supervision of a parent or legal guardian who accepts these Terms on your behalf.
• B. Accuracy. You will provide truthful information and keep your account details up to date.
• C. Your name. Your public name or shop name must not be offensive, misleading, or infringe someone else’s rights.
• D. Security. You are responsible for your password and for activity under your account. Tell us promptly at [email protected] if you suspect unauthorised access.
• E. No transfer. Accounts are personal unless we agree otherwise in writing. You may not sell or transfer your account.

These Terms do not create an employment, agency, partnership, or franchise relationship between you and RiseJewels.

5. Your content

A. Your responsibility. You are responsible for listings, photos, descriptions, reviews, and other content you submit. You must have all rights needed to post that content, and it must not violate law or third-party rights.

B. Licence to RiseJewels. You grant RiseJewels a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, adapt (for example resizing images or translating UI), promote, and distribute your content solely to operate, improve, and market the Services. We do not claim ownership of your items or creative work.

C. Infringement. We respect intellectual property. We may remove content and restrict accounts where we reasonably believe there is infringement or repeated abuse.

6. Your use of our services

You agree to use RiseJewels only for lawful marketplace purposes. You will not, for example:

• Circumvent fees, manipulate reviews, or abuse promotions;
• Send spam, phishing, or harassing messages through our tools;
• Use the Services to distribute malware or scrape data in a way that harms the platform;
• List prohibited items or misrepresent the nature, origin, or price of goods.

We may investigate misuse, apply technical limits, and cooperate with authorities when required.

7. Suspension & termination

We may suspend or terminate access to the Services if you materially breach these Terms, create risk or legal exposure for us or users, or if we are required to by law. You may stop using RiseJewels at any time. Provisions that reasonably should survive (for example, liability limits) will survive termination.

8. Disclaimers & limitation of liability

Except where law does not allow it, the Services are provided “as is”. We do not warrant that listings are accurate, that sellers will fulfil orders, or that the Services will be uninterrupted. To the fullest extent permitted by applicable law, RiseJewels and its team will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill.

Our total liability for claims arising from the Services is, where permitted, limited to the greater of (a) the amount you paid RiseJewels in platform fees in the three (3) months before the claim, or (b) one hundred Indian rupees (₹100).

9. Indemnification

To the extent permitted by law, you will indemnify and hold harmless RiseJewels and its operators from claims, losses, and expenses (including reasonable legal fees) arising from your content, your listings, your breach of these Terms, or your misuse of the Services.

10. Disputes with other users

If you have an issue with another buyer or seller, you should first try to resolve it through order messages. RiseJewels may offer good-faith assistance or mediation-style tools, but we are not a party to your sale contract unless we explicitly say so for a specific programme.

11. Governing law & disputes

These Terms are governed by the laws of India, without regard to conflict-of-law rules. Subject to mandatory consumer protections where you live, courts located in India will have exclusive jurisdiction over disputes arising from these Terms or the Services.

If you are a consumer in a region that gives you non-waivable rights, those rights remain unaffected.

12. Changes & contact

We may update these Terms from time to time. We will post the new effective date at the top of this page and, where appropriate, notify you by email or in-product notice. Continued use after changes means you accept the updated Terms.
